These Terms of Service apply when you access or use Vanguard IT Corp websites,
contact forms, support chat, RD Admin, RD Client, RD Hub, remote support tools,
and related services. If a separate written agreement applies to a managed service,
professional service, or support engagement, that written agreement controls for
that engagement.
Who May Use The Services
You may use the services only if you are legally able to accept these terms and are
authorized to access the systems, hosts, accounts, or support sessions involved. If
you use the services for an organization, you represent that you have authority to
bind that organization or act on its behalf.
Accounts And Access
You are responsible for keeping your credentials, devices, and sign-in sessions
secure. You may access only hosts, groups, support sessions, and client data that
you are authorized to manage. Tell us promptly if you believe an account, token,
device, or support session has been compromised.
Remote Access And Support
Remote access and support tools may allow screen viewing, remote control, keyboard
and mouse input, clipboard use, file transfer, device diagnostics, or connection
launch features depending on configuration. You are responsible for obtaining any
required permission from the device owner, user, client, or organization before
starting or joining a remote session.
Acceptable Use
- Do not access systems, accounts, hosts, or data without authorization.
- Do not use the services to violate law, privacy rights, contracts, or security policies.
- Do not interfere with, scan, disrupt, reverse engineer, or bypass security controls except where law expressly permits.
- Do not upload malware or use the services to compromise any system or network.
Customer Data And Privacy
We handle personal information and support data according to our
Privacy Policy. You are responsible
for the accuracy of information you submit and for ensuring that your use of the
services complies with laws and policies that apply to your organization.
Third-Party Services
The services may rely on third-party platforms, including identity providers,
remote-access infrastructure, Apple services, Microsoft services, hosting providers,
and email or logging providers. Your use of those third-party services may also be
subject to their own terms and policies.
Apple App Terms
If you obtain RD Admin or RD Client through Apple services, these terms are between
you and Vanguard IT Corp, not Apple. Apple is not responsible for providing support
or maintenance for the apps. Apple and its subsidiaries are third-party beneficiaries
of these terms for Apple-distributed apps and may enforce these terms as they relate
to those apps.
Availability And Changes
We may update, suspend, or discontinue parts of the services, including app features,
host access, support workflows, or website functionality. We may also update these
terms by posting a revised version with a new effective date.
No Warranties
The services are provided as available unless a separate written agreement says
otherwise. We do not guarantee that the website, apps, remote access, or support
systems will be uninterrupted, error-free, or compatible with every device,
environment, or third-party service.
Limitation Of Liability
To the maximum extent permitted by law, Vanguard IT Corp will not be liable for
indirect, incidental, special, consequential, exemplary, or punitive damages, or for
lost profits, lost data, business interruption, or unauthorized access arising from
use of the services. Any liability that cannot be excluded is limited to the amount
paid to Vanguard IT Corp for the service giving rise to the claim during the three
months before the claim.
Governing Law
These terms are governed by the laws of the State of New York, without regard to
conflict-of-law rules, unless a separate written agreement states otherwise.
